1. Agreement to Terms

By accessing or using Gixo.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms constitute a legally binding agreement between you and Zencraft Consultancy Private Limited ("Company," "we," "us," or "our") concerning your use of the Service.

2. Service Description

Gixo.ai is an AI-powered content operating system that provides:

AI-assisted content generation for text, multimodal (text + images), presentations, and visual packs

Brand voice analysis and application (Brand DNA™)

Export capabilities that vary by product and may include PDF, DOCX, HTML, Markdown, EPUB, SCORM, and other supported formats

Optional team collaboration, public sharing links, and supported publishing integrations

Unlimited edits on all generated content

Multi-language support and translation services

Integration with various AI providers for optimal content generation

3. User Accounts

3.1 Account Creation

You must provide accurate and complete information

You must be at least 18 years old

You are responsible for maintaining account security

One person or legal entity may maintain multiple accounts for legitimate business purposes

3.2 Account Security

You are responsible for all activities under your account

You must notify us immediately of any unauthorized use

We support secure authentication via email/password and OAuth providers (Google, Microsoft, Facebook, and LinkedIn)

You must not share your account credentials

4. Acceptable Use

You agree NOT to use the Service to:

Violate any laws or regulations

Infringe on intellectual property rights

Generate harmful, offensive, or misleading content

Attempt to bypass plan limits, seat limits, usage controls, or security measures

Interfere with or disrupt the Service

Create content that promotes violence, discrimination, or illegal activities

Use the Service for spam or unsolicited communications

Reverse engineer or attempt to extract source code

5. User Content

5.1 Your Content

You retain ownership of content you create using the Service

You grant us a license to process and display your content within the Service

You are responsible for ensuring you have rights to any content you upload

We may remove content that violates these Terms

5.2 AI-Generated Content

CRITICAL: AI-generated content may contain factual inaccuracies, hallucinations, biases, or errors. You must review and verify all content before publication or use.

Content generated by AI is provided "as-is" without warranty of accuracy, completeness, or fitness for purpose

You are solely responsible for reviewing, fact-checking, and editing all AI-generated content before publication or use

AI-generated content may contain biases, outdated information, or hallucinated facts that appear plausible but are incorrect

You must comply with applicable laws regarding AI-generated content disclosure and transparency

Liability: We are not liable for any damages, losses, or legal consequences arising from your use or publication of AI-generated content

You are responsible for ensuring AI-generated content does not infringe third-party intellectual property rights

6. Intellectual Property

6.1 Your Content Ownership

Your Content is Private and Yours

You own all rights to your generated content. Content is private by default inside your account. Gixo.ai also provides optional sharing and publishing features that you control, including team sharing, public share links, exports, and integrations with third-party publishing destinations.

Complete Ownership: You retain all intellectual property rights to content you create using the Service

Private by Default: Your content is stored privately until you intentionally share, publish, or export it

User-Controlled Sharing: If you create a public link, share with a team, or publish to an external destination, access is governed by the permissions and destinations you choose

Your Publishing Responsibility: If you publish, distribute, commercialize, or share generated content through Gixo.ai or elsewhere, you are solely responsible for ensuring it complies with all applicable laws and does not infringe third-party rights

Export Freedom: Available export formats depend on the product and content type you are using

6.2 Our Platform

The Service itself, including its original content, features, software, user interface, and functionality, is owned by Zencraft Consultancy Private Limited and is protected by international copyright, trademark, and other intellectual property laws. Your license to use the Service does not grant you any ownership rights to the platform.

6.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service (not your generated content) become our property and may be used to improve the platform without compensation to you.

7. Payment Terms

7.1 Billing

Paid plans are billed through the provider associated with your purchase source, including Lemon Squeezy for direct web purchases and the applicable marketplace provider for AWS, Microsoft Azure, or Google Cloud Marketplace purchases

Prices are subject to change with 30 days notice

All fees are exclusive of taxes, which will be added where applicable

7.2 Subscriptions and Product Plans

We offer product-specific subscriptions with multiple tiers. Pricing, included features, and billing intervals are shown at checkout and in the billing portal and may vary by product.

7.3 Seats and Team Access

Included seats, minimum seat counts, and any per-seat pricing vary by product and tier. Current seat entitlements and any seat-based charges are shown at checkout, on your invoice, and in your billing portal.

Seat-based plans: Some products are sold on a per-seat basis and may allow additional seats above the tier minimum. Any additional-seat pricing or quantity changes will be reflected by the applicable billing provider.

7.4 Usage Capacity

Paid subscriptions include a recurring usage capacity allowance for the applicable product. Capacity resets each billing cycle and does not roll over. Edits and revisions to existing content are unlimited. We may enforce reasonable use controls to prevent abuse, automated scraping, or other unauthorized usage.

7.5 One-Time Purchases

Some offerings may be sold as a one-time purchase (for example, a publishing pass). One-time purchases do not renew automatically. Any included entitlements are delivered as described at checkout and in your account.

7.6 Refunds

See our Refund Policy for details on refund eligibility. Refund windows: 7 days for monthly plans, 30 days for annual plans (subject to eligibility and usage).

8. Termination

8.1 Termination Rights

You may terminate your account at any time through account settings or billing portal

We may terminate or suspend accounts that violate these Terms

Upon termination, your right to use the Service ceases immediately

8.2 Content Retention After Termination

90-Day Export & Reactivation Window

After subscription cancellation or expiration, we may retain content and account data for up to 90 days to support export or reactivation, unless a verified deletion request is processed sooner.

Retention Window: We may retain content and account data for up to 90 days after cancellation or expiration to support export or reactivation

Reactivation: If your subscription is restored during that window, your content and settings may remain available, subject to the then-current product state and retention workflow

Export: Available export formats depend on the product and content type in your workspace

Deletion Workflow: After the retention window, content and account data may be deleted, de-identified, or retained only as required for legal, billing, security, or backup purposes

Deletion Requests: You may request account deletion through the product or by emailing privacy@gixo.ai. Verified requests are handled under our deletion and anonymization workflow and may disable account access before all underlying records are removed

Billing Records: Depending on your purchase source, invoices and transaction records are maintained by Lemon Squeezy, AWS Marketplace, Microsoft commercial marketplace, Google Cloud Marketplace, or another payment provider used for your purchase. We may retain minimal billing metadata (for example, transaction IDs and subscription status) for up to 8 years for legal and tax compliance.

Legal Retention: Certain data may be retained longer for legal compliance as required by our Privacy Policy

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENCRAFT CONSULTANCY PRIVATE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM AI-GENERATED CONTENT ERRORS, THIRD-PARTY AI PROVIDER OUTAGES, OR SERVICE INTERRUPTIONS.

10.5 Force Majeure and Service Dependencies

Third-Party Dependencies: Our Service relies on third-party AI providers. We are not liable for interruptions caused by these external services.

We are not liable for service interruptions, delays, or failures caused by events beyond our reasonable control, including but not limited to:

Third-Party AI Provider Outages: Interruptions from OpenAI, Anthropic, Google, Microsoft, or other AI service providers

Internet/Network Failures: Internet service provider outages, DNS failures, or network infrastructure issues

Acts of God: Natural disasters, earthquakes, floods, fires, pandemics, or severe weather events

Government Actions: War, terrorism, government restrictions, sanctions, or regulatory changes

Cyberattacks: DDoS attacks, hacking attempts, or other malicious activities beyond our control

Infrastructure Failures: Power outages, data center failures, or cloud provider disruptions

Service Level Commitment: In the event of extended service interruptions exceeding 48 consecutive hours due to third-party AI provider outages, we may, at our sole discretion, provide a pro-rated subscription extension, fee adjustment, or other remedy.

11. Indemnification

You agree to indemnify, defend, and hold harmless Zencraft Consultancy Private Limited, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

Your Use of AI-Generated Content: Any claims arising from your publication, distribution, or commercial use of AI-generated content

IP Infringement: Claims that AI-generated or user-uploaded content infringes third-party intellectual property rights

Violation of Terms: Your violation of these Terms of Service or any applicable laws

Third-Party Rights: Violation of any third-party rights, including privacy, publicity, or other personal rights

Misuse of Service: Fraudulent, illegal, or unauthorized use of the Service

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Mumbai, Maharashtra.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service.
